We understand how prosecutors approach gambling in Utah and use this knowledge to broker timely and favorable resolutions to our clients’ cases. It is deemed by the Legislature that this chapter is necessary for the more efficient and proper enforcement of the statutes and laws of this state prohibiting lotteries and gambling, and a lawful exercise of the police power of the state for the protection of the public welfare, health, safety and morals of the people of the state. All the provisions of this chapter shall be liberally construed for the accomplishment of these purposes. This chapter may not be construed, interpreted, or applied to the possession of a reverse vending machine.
Nothing in this section shall supersede any provision of Federal, State, or other law imposing criminal penalties or affording civil remedies in addition to those provided for in this section. Court authority over assets.—A court may issue a pretrial restraining order or take any other action necessary to ensure that any bank account or other property held by the defendant in the United States is available to satisfy a judgment under this section. Rule of construction regarding preemption.—Nothing in this subchapter may be construed to preempt any State law prohibiting gambling. State.—The term “State” means any State of the United States, the District of Columbia, or any commonwealth, territory, or other possession of the United States. In general.—The United States, acting through the Attorney General, may institute proceedings under this section to prevent or restrain a restricted transaction.
The New Jerseylottery was successful because it stressed frequent action at low cost, and it returned a higher percentage of lottery revenues as prizes. There were also various attempts to legalize a national lottery, but they failed to be passed by Congress. Part of the reason for Mr. Siegel’s success was due to his connection to the underworld. Wartime shortages did not slow down his plans because of his ties to the black market and his political connections.24The lavish casino he built opened with such stars as Jimmy Durante, Xavier Cougat, and George Raft. “Organization” means an organization which is exempt from federal income taxation pursuant to 26 U.S.C. s. 501, , , , , or , and which has a current determination letter from the Internal Revenue Service, and its bona fide members or officers. Property owned by a municipality or a county when the governing authority has, by appropriate ordinance or resolution, specifically authorized the use of such property for the conduct of such games. Any organization conducting bingo open to the public may refuse entry to any person who is objectionable or undesirable to the sponsoring organization, but such refusal of entry shall not be on the basis of race, creed, color, religion, sex, national origin, marital status, or physical handicap. Have in her or his possession any so-called “run down sheets,” tally sheets, or other papers, records, instruments, or paraphernalia designed for use, either directly or indirectly, in, or in connection with, the violation of the laws of this state prohibiting lotteries and gambling. The cardroom shall be deemed an accessory use to a licensed pari-mutuel operation and, except as provided in chapter 550, a municipality, county, or political subdivision may not assess or collect any additional license tax, sales tax, or excise tax on such cardroom operation.
The charitable organization shall provide a participant using an electronic bingo aid with corresponding paper bingo cards or sheets. Except as otherwise provided in division of this section, conduct more than three bingo sessions in any seven-day period. A volunteer firefighter’s organization or a volunteer rescue service organization that conducts not more than five bingo sessions in a calendar year may conduct more than three bingo sessions in a seven-day period after notifying the attorney general when it will conduct the sessions.
Individual members of industry may have donated to charitable organizations that promote the counseling and treatment of problem gamblers. There are different approaches to educating the public about problem gambling. Toll-free help-lines have become popular and one can see posters or stickers with the number posted in casinos. Public service announcements on television and radio have also become popular. These announcements are often sponsored by the casino industry or a specific casino company. Effectiveness Rate of Treatment is Not Accurately Known.Although individual pathological gamblers can be quite successfully treated, little is known about the effectiveness of treatment programs.
